The following Terms and Conditions of Use (hereinafter referred to as “Terms”) shall govern the use of the website chrisholmesantiques.co.uk.
Users must only register to use the Service to purchase or to make a request to Chris Holmes Antiques. Registration and creation of a user account are free of charge. Minors and individuals who have no or only limited legal capacity may not register or checkout as ‘guest’.
2.1 At ‘checkout’ when either registering an account or checking out as ‘guest’, the User is obligated to provide truthful and complete information. If any changes occur regarding the information collected after the registration the User shall update the data in his/her user account without undue delay or – if possible – inform Chris Holmes Antiques about the change. By sending the completed registration checkout form the User submits an offer to conclude a contract regarding the use of chrisholmesantiques.co.uk, he agrees to these Terms and affirms not to be excluded from the use of the Service.
2.2 Chris Holmes Antiques may reject a sale without stating reasons.
2.3 A contract will come into effect when checkout is complete. A confirmatory email of the registration and checkout will be received by the User. In receiving this confirmatory email the contract regarding the use of chrisholmesantiques.co.uk has been concluded between the User and Chris Holmes Antiques.
2.4 During registration/checkout the User may register an account or checkout as a ‘guest’. Registration covers his/her user name and a password (hereinafter referred to as “Access Data”). • breached these Terms • registered more than once In the case that a user account is blocked the User concerned is not allowed to register again without the express prior approval of Chris Holmes Antiques.
3. Conclusion of Purchase Contracts and Shipping
3.1.1 Chris Holmes Antiques has various shipping options available for selected locations and parcel sizes when the User selects ‘Arrange my delivery for me’. Worldwide shipping is available via a number of shipping logistic companies. Large and bulky items are shipped via our specialised furniture delivery partner. All deliveries are to the kerb-side. For heavy items please ensure that someone is available to assist with off-loading on arrival as we are only able to send out one driver. If you wish to have your item delivered into your home please get in touch with Chris Holmes Antiques at [email protected] before placing your order as additional handling cost will apply.
3.1.2 When selecting ‘Arrange my delivery for me’ you the User are responsible for leaving correct contact information in the form of email and phone number. Chris Holmes Antiques will be in touch as soon as possible within business working hours to discuss options with you. Delivery costs are calculated after purchase, however if you the User wish to discuss costs prior to purchase for a personal shipping quotation please contact Chris Holmes Antiques on [email protected]
3.1.3 The logistics process is as follows: 1.The Purchaser provides any information that is relevant to the item’s transportation. 2.Chris Holmes Antiques sources transportation quotes. 3.The Purchaser agrees on one of the provided quotes or decides to arrange transportation by themselves. 4.If Chris Holmes Antiques is to organise transportation, Chris Holmes Antiques will collect all transportation costs before the transportation takes place. An email will be sent to the Purchaser/User with an online link to provide payment for these services. Goods will not be despatched until payment is cleared.
The final cost of transportation (including transportation insurance) is the responsibility of the Purchaser.
Chris Holmes Antiques is not responsible for any increases of duties and taxes. Any increase or decrease in duties and taxes will be passed on to the purchaser
If a Purchaser does not use the logistics services offered by Chris Holmes Antiques, they are solely responsible for arranging transportation.
3.1.4 Shipping times will vary. Items will be shipped once payment has cleared. Parcels usually arrive 2-4 weeks after your order, bulky items usually 3-6 weeks after your order. Your order may arrive to you in more than one parcel.
3.1.5 Chris Holmes Antiques will notify the User as soon as the item has been shipped with any tracking numbers available.
3.1.6 Chris Holmes Antiques insist on comprehensively insuring all items until the item is received or signed for. It is required that the User inspects their order as soon as it arrives, and in the event any item is damaged during shipping to notify Chris Holmes Antiques immediately with photographs of the packaging, and of the item itself. The shipping company is ultimately responsible to reimburse you for any damage that occurs during shipping. If the User confirms receipt of the item and does not notify Chris Holmes Antiques of any defect within two days after the receipt, Chris Holmes Antiques will not be able to assist in claiming for damages caused by the shipper.
3.2.1 When selecting ‘I’ll collect my order” or ‘I’ll arrange my own delivery’ the User or transportation company assigned by the User must contact Chris Holmes Antiques via email [email protected] or phone +447771 962494 to arrange a suitable time for collection. The shop is subject to changeable opening hours due to antique fairs, public holidays and buying trips so it is imperative that you must check to ensure availability on arrival to avoid dissapointment Generally opening hours are 10:30am—5.30pm Wed—Sat, 12—4pm Sun, however please check in advance.
3.2.1 Our shop address is: Chris Holmes Antiques and Art, 22–24 Finkle Street, Knaresborough, North Yorkshire HG5 8AA, United Kingdom. Some larger items may be collected from a secondary warehouse storage address within 10 miles of the shop, we will inform you of the items whereabouts on purchase and the above options have been selected in 3.2.1
3.2.2 When selected ‘I’ll collect my order’ or ‘I’ll arrange my own delivery’ The User must arrange to collect the item within 14 calendar days after the purchase date. After 14 calendar days the items will enter storage. If further storage is necessary the user bears all costs. Please email [email protected] for more information.
3.2.3 Items uncollected within 6 months without prior arranged storage or near future delivery or collection date, will be resold and no monies refunded to the User.
3.2.4 If items need to be stored for longer than 14 days this may be done so by prior arrangement by contacting [email protected] to discuss and confirm storage timescales, availability and costs.
4. Purchase of Antiques online
4.1 All goods are sold as seen. Please use photographs as part of items description and condition and refer to description as guideline to antique condition.
4.2 You, the User are wholly responsible for making sure that you take note of the sizes of items supplied on our website and measure up before ordering. We will not accept return of items that do not fit through doorways or are incorrect for spaces. We have made sure that measurements are clear and correct on our website to ensure you have all the information you need before you purchase. If such issue ever arises it will be at the Users cost.
5. Purchase of original Art online
5.1 Terms of payment for existing original artworks.
Payment is to be made wholly before work will be despatched. Work will be despatched on average between 2-3 weeks days after receipt of payment.
5.2 © Copyright existing in ‘artistic works’, covering paintings, drawings, diagrams and photographs remains with the artist. These are protected irrespective of the artistic quality. Surface decoration on 3-D designs will also be covered by copyright. No formalities are required. The right is automatically created once the design is recorded in some permanent form.
5.3 Copyright lasts for the life of the artist plus 70 years after the artists death.
5.4 Assignment. The ownership of any rights can be changed by agreement (contract) between respective parties. In practice parties need to decide whether the rights are to be assigned (sold) in full or part, or whether they are to remain with the artist. If the rights are assigned, the artist will loose control over the work, except in so far as any moral rights are concerned.
5.5 Legal action will be taken if infringement of copyright occurs. Infringement of copyright covers copying of work; issuing copies to the public; performing, showing or playing the work in public; broadcasting or distributing the work via cable and making an adaptation of the work.
5.6 Delivery of works of art will be arranged through a specialist Fine Art distributer via Chris Holmes Antiques. If work is agreed to be collected the same conditions apply as above in sections 3.2.1 through 3.2.4

6. Use of Contact Details

Chris Holmes Antiques may save and process any data relating to the User, to the extent necessary for the purpose of the execution and implementation of this use contract and of purchase contracts concluded via chrisholmesantiques.co.uk as long as Chris Holmes Antiques is required to keep such data in accordance with applicable laws.
